Cancellation of Provisional Admission of Mr. Abrar Ahmed for MBBS Course - 2023

In light of the recent developments and as per the guidelines and regulations of the Jammu and Kashmir Board of Professional Entrance Examinations (JKBOPEE), we regret to inform you of the cancellation of the provisional admission of Mr. Abrar Ahmed for undergoing the MBBS course for the academic session 2023-24. This cancellation is based on the assessment of Mr. Ahmed's eligibility under the Persons with Disabilities (PwD) category.

The following references and events have led to this decision:

  1. The National Eligibility-cum-Entrance Test (NEET) was introduced by the Medical Council of India (MCI), now known as the National Medical Commission (NMC), in 2010 to conduct uniform entrance examinations for medical education institutions at both undergraduate and postgraduate levels.

  2. After the NEET-UG results were declared on 30.06.2023, the Ministry of Health and Family Welfare, Government of India provided the results of candidates from the UT of J&K/Ladakh who appeared in the NEET to the JKBOPEE.

  3. The JKBOPEE notified the roll number-wise list of candidates from the UT of J&K/Ladakh who appeared in NEET-UG 2023 on 06.07.2023.

  4. Online registration for NEET-UG 2023 candidates belonging to the UT of J&K/Ladakh was notified on 15.07.2023.

  5. The Provisional Merit List (PML) of NEET-UG-2023 candidates from the UT of J&K and Ladakh was issued on 27.07.2023.

  6. The Provisional Selection List of eligible candidates for NEET-MBBS/BDS Courses, 2023, for UT of J&K/Ladakh was issued on 11.08.2023, with a clear warning regarding the veracity of documents, especially category certificates.

  7. Mr. Abrar Ahmad applied under the PwD category and was provisionally allotted a seat in GMC, Udhampur under the PwD-ST category.

  8. The Government Medical College, Udhampur, initiated the process of assessing the disability of the candidates provisionally selected for the UG-NEET Session 2023-24.

  9. A Special Medical Board was constituted by GMC Jammu to assess the disability of PwD candidates, including Mr. Abrar Ahmad.

  10. The Special Medical Board's report on Mr. Ahmad concluded that he had no disability, and any symptoms he had could be treated by the removal of implants.

  11. The report was forwarded to JKBOPEE, which prompted the examination of Mr. Ahmad's eligibility under the PwD category.

  12. Mr. Abrar Ahmad filed a writ petition (2654/2023 CM No. 6278/2023) in the Hon'ble High Court of J&K and Ladakh at Jammu, seeking to prevent the cancellation of his provisional selection and admission to the MBBS course.

  13. The Hon'ble Court passed an order granting respondents three weeks to file objections, with the next hearing scheduled for 15.11.2023.

  14. Given the medical assessment report and recommendations received from GMC Jammu, Mr. Abrar Ahmad has been found ineligible under the PwD category.

  15. Mr. Ahmad has no disability, and his symptoms can be treated by the removal of implants.

  16. The Hon'ble Court has not issued any directive restraining JKBOPEE from canceling the provisional selection of Mr. Abrar Ahmad based on his ineligibility.

Therefore, in light of the above developments and the absence of any court directive to the contrary, the provisional selection of Mr. Abrar Ahmed for the MBBS course at GMC Udhampur, which was initially notified on 11.08.2023, shall be deemed to have been canceled ab initio.

This decision is in accordance with the guidelines and regulations set forth by JKBOPEE and the National Medical Commission. We urge all concerned parties to take note of this decision, and we remain committed to ensuring fair and transparent admissions in the medical education institutions of the UT of J&K and Ladakh.
